Weingarten權利

瞭解你的權利:代表權

如果上司或經理要求你面談,調查情況並議定處罰,則你所擁有的明確代理權利可以概括如下:

  1. 你有權要求工會代表出席。
  2. 若希望代表在場,你必須事先申請。
  3. 如果不瞭解會面原因,直接詢問經理:會面是否會導致處罰。
  4. 如果經理拒絕代表到場,在證人面前重複你的要求。不要拒絕到會,但也不要回答任何問題。記錄會議內容。會議結束就給代表打電話。
  5. 你有權在會前和會中與代表私下交流。
  6. 代表不僅是旁觀者,他/她有權積極參與會議。

上述權利名為“Weingarten權利”,它源於最高法院1975年的一項裁決。(國家勞資關係委員會對J.Weingarten)。不加利用就意味著放棄,所有權利都是如此。

"If this discussion could in any way lead to my being disciplined or terminated I respectfully request that my steward be present at the meeting. Without representation present, I choose not to respond to any questions or statements."
